Karwar Express and Kannur Express - Confusion creating Railways Penalised

The same locomotive pulls 16523 Karwar and 16517 Kannur till Mangalore


Same engine pulls trains to both Karwar and Kannur; confused passenger missed train and sued Railways in consumer court


A train with two destination names confused a passenger and he failed to board it. He was to board the Karwar Express (night train) but the first half of the train's coaches had boards identifying it as the Kannur Express. It was only when the train was moving that he noticed that the last few coaches were marked as Karwar Express. After missing the train, he filed a complaint with the consumer forum in Bangalore which has held the Railways responsible for deficiency in service and confusing passengers and fined it. This has come as yet another instance of the confusion created by the Railways to use the same locomotive to pull the trains to Kannur and Karwar till Mangalore, from where they are separated to head to their respective destinations.


Anup Nair, a resident of Thippasandra, filed the complaint last year on October 28. He had purchased a ticket to travel from Bangalore to Byndoor Mookambika Road (the railway station used by those heading to the Mookambika temple) on August 31, 2013, to perform a ritual called the 'Vidyarambh' at the Mookambika temple. He claimed to have reached the City Railway Station one hour in advance before the train was to depart at 8.40 pm. At the enquiry counter, he was told that the train would depart from platform number 10. Anup says he checked the display chart on the platform and that too showed train No. 16523 Karwar Express, along with train No. 16517 Kannur Express.


A train arrived at 8.20 pm on platform 10, and the digital signboard indicated it as 16517 Kannur Express. Even the coaches on the train had boards that read Kannur Express. Anup verified his ticket to confirm that it said Karwar Express. The complainant said he checked the TVs installed on the platform and found they were either showing only advertisements, or were not working. The train on the platform began to move and as it left the station, Anup noticed to his dismay that some of the coaches at the end had boards which said Karwar Express.


Anup could not board the moving train. Later he came to know that both the Kannur Express and Karwar Express were pulled by the same engine. When he confronted the officials, he was refunded Rs 465 out of the ticket fare of Rs 945.


In the consumer court, the Divisional Manager of South Western Railways claimed that Karwar Express left Bangalore City Railway Station at the scheduled time of 8.40 pm and there was no delay. Since the display showed Karwar Express too, the consumer was not misled. He claimed that "train No 16523 Karwar Express and 16517 Kannur Express leave as a single formation from Bangalore to Mangalore, where they are bifurcated. The coach position is disseminated through a public announcement system and electronic display boards. Hence, there was no reason for the complainant to presume that the train would come late... "


The court in its order, said: "The facts clearly goes to show that there was no proper display at the railway station on platform No.10 clearly stating that both Karwar Express and Kannur Express are one and the same, and there was no separate display of the train number of Karwar Express on that platform....That led to confusion to the complainant. In our opinion, the contention of the complainant is acceptable because when two trains are departing from the same platform and pulled by the same engine, the opposite party ought to have displayed in the digital sign board the train numbers and the names of both the trains, and not doing so leads to confusion to passengers." The court directed the Railways to refund Rs 480 to Anup along with a compensation of Rs 5,000, and another Rs 2,000 as litigation cost.


LONG-LASTING CONFUSION

The confusion over the two trains from Bangalore to Karwar and Kannur is a creation of the Railways. Ever since the metre gauge track between Bangalore and Mysore was converted to broad gauge, there was a demand to introduce a night train to Karwar. The first train (on the broad gauge) was introduced between Bangalore and Mangalore, but it was extended to Karwar in 2009. It would have been a long distance train running entirely within Karnataka. However, the train was later extended to Kannur in Kerala. Then came a High Court order directing the train to Karwar. The Railways bifurcated the train. While a few coaches were extended to Karwar, and the others continued towards Kannur.
Meanwhile, from Independence Day this year, the Railways has decided to shift the origin point of Yeshwantpur Kannur/ Karwar Express to Bangalore City Railway station (Majestic) instead ofYeshwantpur. The reason? Kannur Express was creating confusion even at the Yeshwantpurstation. Passengers who used to board the train at Yeshwantpur (the originating point) were caught between two Kannur Express' which used to start from the same place and at almost same time! To avoid confusion about the two 'Kannur' trains (16527 and 16517) leaving Yeshwantpur at almost the same time, the combined Karwar/Kannur Express is now starting from the City RailwayStation, instead of Yeshwantpur station

NO.20344/20 10 and connected appeals by order dated 31.05.2010, confirmed the market value of the land acquired for Sea Bird Project, at Rs. 11,500/- per gunta. In that view of the matter, these appeals do not survive for consideration. Appeals are accordingly dismissed.

Tough Competition in the Karwar LS Constituency

The “Modi wave” seems to be working in this constituency to some extent as NaMo brigades were formed in villages much before the elections were announced. Though Hegde faces anti-incumbency at most places, he may still get many votes as workers of the BJP and the Sangh Parivar have been seeking votes in Modi’s name. The BJP had won four Assembly seats in 2008, but just one in 2013.

For Prashant, his father’s sway over the region may come in handy, and he has tried to engage with people in the last five years through social service. He is also known to be polite and highly educated. The Congress workers are also highlighting the State government’s schemes. But there are many sections which do not like the elder Deshpande, saying he did not do much for the constituency despite being a minister for several years. “The Hindutva Hegde is talking about will not bring development. Voters know that it was R V Deshpande who brought investments worth Rs 1,200 crore to the district,” claimed MLC, Shrikanth L Ghotnekar of the Congress. But BJP leader Raju Dhooli from Haliyal has asserted that Deshpande “failed” to develop the district. For Deshpande, his son’s victory appears to be a “prestige issue”. He also roped in Congress vice president Rahul Gandhi to address a rally at Sirsi. Besides, the Congress has four MLAs and the support of independent MLAs. Both the parties face factionalism, a fact they deny. Margaret Alva’s son Nivedith aspired for the Congress ticket. Though Nivedith and his supporters have been canvassing for Prashant, their efforts are being seen as “half-hearted”. In the BJP, politicians are canvassing for Modi and not the candidate.

The issues being discussed are rehabilitation of the displaced, CRZ, filling tanks with Kali water, widening of national highway, the rumoured ban on areca nut, environmental concerns, protection of forest dwellers’ interests and railway line projects. At present, the Congress and the BJP seem to be ahead in only one or two Assembly segments, and equally placed in the rest.

A survey conducted by a prominent Kannada daily in association with C fore has predicted that the voters of Karnataka will not be totally swept off their feet by Modi wave, unlike some other states. As per the calculations made based on opinions  put together under this survey, the 28 Lok Sabha seats in the state are expected be shared by the three major political parties, Congress (14), BJP (12), and JD(S) (2).


If the prediction made by this survey comes true, Congress will gain seven seats as compared to the previous Lok Sabha election, at the cost of BJP. It is being analyzed that the voters, in spite of having been frustrated at the lackadaisical performance of the union government, have continued to favour Congress because of the internal bickering within the BJP. Congress will possibly wrest back its prominence in Old Mysore and Hyderabad Karnataka regions of the state as per the survey, which says that the Congress is likely to win 11 out of the 14 seats. The fact that Siddaramaiah is the chief minister, and Hyderabad Karnataka has been covered under section 371J, are likely to score major points for the Congress. JD(S) will have to be content with only a token presence, as the survey has given it an edge only in Hassan and Tumkur constituencies.

The BJP, which suffered an ignominious defeat in the assembly election because of parting of ways with Yeddyurappa last time, is expected to perform well in Bangalore, Mumbai-Karnataka, and central Karnataka regions. Out of the three seats it won from the state capital last time, BJP is predicted to retain two. BJP is set to lose Bangalore (central), Bellary, Udupi-Chikmagalur, Bidar, Raichur, Dakshina Kannada, Chitradurga and Tumkur constituencies, as the voters are unhappy with the functioning of current incumbents, the survey analyses. On religion and caste-based calculations, minorities, backward classes, and dalits are likely to support the Congress, as Siddaramaiah is projected as their hope. Vokkaliga votes will go to BJP wherever JD(S) does not have strong footing. A large number of voters surveyed felt that Congress can improve its chances in the election by giving the post of deputy chief minister to Dr Parameshwar. However, more people have preferred Narendra Modi to become the prime minister, as compared to Rahul Gandhi, with only a miniscule percentage choosing Arvind Kejriwal.

Justice V G Sabhahit Dies in his Court Chamber

 Senior Judge of the High Court of Karnataka Justice V G Sabhahit died in his chamber at the court, following a cardiac arrest on Monday.

Justice Sabhahit, who returned to his chamber after completing court proceedings in the evening complained of chest pain. His staff immediately called the doctors who arrived at his chamber and suggested that he be shifted to the hospital at once. However, the hospital authorities declared him brought dead.

Justice Sabhahit, who was suffering from heart problems, had suffered two heart attacks earlier. Justice Sabhahit was born on November 26, 1955. He enrolled as an advocate in 1979 and practised in the High Court before he joined the Karnataka Judicial Service as district judge on April 18, 1988.

He was promoted to the cadre of district judge (super time scale) on November 22, 1995.

Sabhahit was appointed as additional Judge of the High Court of Karnataka in 2000, and was made a permanent Judge in 2001.

Several legal experts have expressed their condolences over the death of Justice Sabhahit. 

Incidentally, Sabhahit’s father, G N Sabhahit, also a judge of the High Court had died in his chamber at the court.

Justice Sabhahit’s order pertaining to the disqualification of Ninge Gowda under the Panchayat Raj Act is considered a benchmark for disqualification cases.

 He was third in seniority among judges in the High Court of Karnataka.

Justice Sabhahit was in the limelight when eleven BJP MLAs had rebelled against B S Yeddyurappa in 2010. The dissident MLAs had approached the High Court of Karnataka where a specially constituted Bench consisting of Chief Justice J.S. Kehar and Justice N. Kumar heard the pleas of the BJP MLAs against their disqualification. The Bench heard their pleas and gave a split verdict with Justice Kehar upholding their disqualification while Justice Kumar was in favour of setting aside their disqualification.

The matter was then heard by a third judge, Justice VG Sabhahit who upheld their disqualification. Justice V.G. Sabhahit held that it was clear that the contents of the letter given to the Governor by the MLAs would lead to the inevitable inference that the intention of the petitioners was to voluntary giving up membership of the BJP.

While Justice V G Sabhahit died after a cardiac arrest in the Karnataka High Court on Monday, his father, a former HC judge, too died while performing duty.

Justice Sabhahit’s father, G N Sabhahit, was a judge during Justice P C Jain’s tenure as the Karnataka chief justice (1986 to 1989). He had a heart attack while conducting proceedings and died in his chamber in the High Court.

Last year, Justice V G Sabhahit’s gunman Pandu died of cardiac arrest while on duty.

Justice Sabhahit hailed from the coastal town of Idugunji.

Justice Sabhahit was honoured with a state funeral on Tuesday with several dignitaries, including legal luminaries, paying their respects to him.

Incidentally, the annual Late Justice G N Sabhahit Memorial Trust Lecture, was to be held at Karwar, in connection with which Justice V G Sabhahit had visited Karwar on the preceding Sunday.

Rich tributes were paid to the departed Soul, and native of Karwar district, by the Judges, DC, Advocates, and members of Karwar District Bar Association, at Karwar on Tuesday.

Justice Shylendra Kumar visits District Bar Association, Karwar

After taking over as the Administrative Judge of the District, Justice Shylendra Kumar of the Karnataka High Court, came visiting to Karwar, on the 18th May 2010. These pictures were taken in the Karwar District Bar Association, where His Lordship addressed the lawyers assembled in full quorum.

The District and Sessions Judge - Sri. B. M. Angadi, Fast-Track Judges - Sriyuths Balekai and Sarvodaya Shettigar, Senior Civil Judge and CJM - Sri. Narayanappa, Additional Senior Civil Judge - Sri. Siddalinga Prabhu, and Junior Civil Judge and JMFC - Smt. Pallavi, were also present.

Justice Shylendra Kumar, then inspected the New Court Complex, and the on-going Construction of the First Floor of the Complex. He found glaring defects in the Construction and advised the Bar Members to file Criminal Complaints against the erring Officials and the Civil Contractor. Interestingly, the PWD Officials, and the Contractor or his workmen were not present on that day.

His Lordship also inspected the site where the Construction of the Lawyers' Chambers was in progress, next to the existing Sessions and District Court building, built during the British times at Karwar.

The President, Secretary, B. S. Pai and other Senior Members of the Karwar Bar accompanied Justice Shylendra Kumar.

High Court Stay - Transfer of Patrika Bhavan from Karwar to Sirsi

Justice S Abdul Nazeer of the circuit Bench of Karnataka High Court at Dharwad has stayed the operation of the order issued by the director, department of information, who had ordered the transfer of funds meant for the Patrika Bhavan from Karwar to Sirsi. 


Two separate writ petitions were filed by the Journalists Associations of Karwar. The petition contended that Rs 25 lakh was released by the government to construct Patrika Bhavan in every district headquarter of the state for the use of the working journalists.  But the director of the information department had written a letter to the deputy commissioner of Uttara Kannada district on February 2, asking him to divert the fund to Sirsi. The director had cited that the Journalists Union in Sirsi was recognized by the State Journalists Association and there was no land available in Karwar to build the Bhavan.

The Journalists Association of Karwar had challenged the order contending that the state government had allotted the amount to the district headquarters and the director of the information cannot change the decision of the government. Karwar journalists had shown that they have the land available to build the Patrika Bhavan and the director of the information department had acted unilaterally without giving the proper opportunity to Karwar journalists to prove their case. They had submitted enough evidence to the court that according to the state policy, the money had to be sanctioned to the district headquarters and not to any association or union of journalists. The high court upheld the argument of the Karwar journalists and stayed the operation of the order issued by the director of information department in this regard. 
Advocates V P Kulkarni and K V Kalwad argued on behalf of the Karwar journalists.

Karwar Lawyers Pay Homage to the 26-11 Victims

We, as small Group of Lawyers friends at Karwar paid Homage to the valiant Heroes and the innocent victims of the 26-11 Mumbai Terror Attacks, at the residence/office Mr. Pradeep M Naik Advocate.

Mumbai's prominent landmarks like the Leopold Cafe, Cama Hospital, Oberoi Trident, Chhatrapati Shivaji Terminus, Taj Mahal Palace and Tower, Nariman House fell prey to the Pakistan based Lashkar-e-Toiba operatives. Several brave officers of the Mumbai Police force like Joint Commissioner of Police, Anti-Terrorist Squad, Hemant Karkare, Police Inspector, Anti Extortion Cell, Vijay Salaskar and Additional Commissioner of Police Ashok Kamte fell prey to the bullets. National Security Guards and Marine Commandos were summoned to bring the situation under control. The NGS also lost its two personnel, Major Sandeep Unnikrishnan and Commando Gajendra Singh. The day is a tribute to all those martyrs who gave up their lives to ensure others could live to tell their tales and a salute to the bravery of those who survived. The first anniversary of the horrific 26/11 Mumbai terror carnage was also the 60th anniversary of the adoption of the Indian constitution but sadly, this did not get the attention it deserved, a Rajya Sabha MP lamented Thursday. ‘This morning, when we assembled, we paid tribute to the victims of the 26/11 attack. But we have forgotten that our constitution was adopted on 26th November 1949. Today is the 60th anniversary of that momentous event,’ Bharatiya Janata Party member S.S. Ahluwalia said during zero hour. ‘Sadly, there is no mention of this in the media. Parliament too has forgotten about it. There was not even a bouquet placed in the Central Hall where the constitution was adopted,’ Ahluwalia added.

News - Dubai-bound ship runs aground near Karwar

Karwar (KTK),Jul 17 (PTI) A Dubai-bound commercial ship with 11 crew members, including six Indians, on board today ran aground off the Karwar coast.

The ship travelling from Malaysia to Dubai was carrying 10 crew members, including six Indians, three Iranains and a Siberian national, in addition to the captain, Karwar Port Director Mohan Raj Gatta said.

The authorities deployed tugs and launched operations to rescue the crew, he said.

The ship M B Shaheen, carrying fuel and lubricant oil, is owned by Five Flower Trading Company of Obalali state of Dubai, Gatta said.fullstory

New District Court Complex Building Inaugurated in Karwar

The new District Court building in Karwar was inaugurated by Chief Justice of the Karnataka High Court P.D. Dinakaran on 10th January, Saturday, 2008.


The Chief Justice sanctioned an additional district judge for the Sessions Court in Karwar and a fast-track court for Sirsi, on the occasion. Mr. Dinakaran urged the people to settle petty cases among themselves. They could take the help of Lok Adalats in such cases, he added. High Court judge K. Bhaktavatsala said that the delay in delivering judgments could be attributed to several reasons. Most of the cases were pending because of lack of subordinate staff members in courts, he said. Another reason for the delay in delivering judgments was minor errors committed by lawyers in preparing documents, he said.

JUDGE HOLDS THE RECORD FOR WRITING 1500 JUDGEMENTS IN KANNADA

While it is argued that implementing Kannada in Courts is quite difficult, here is a Judge in Shimoga who has given more than 1500 judgements, all in Kannada. Justice H.S.Mittalkod of the Fast Track Court here in Shimoga has been consistently giving all his judgements in Kannada since 1985 and this figure has now crossed 1500 mark. Not only the judgements, even the entries made by him in the court-diaries are also in Kannada. As per his instructions all entries made in the court-diaries are in Kannada. Mittalkod started using Kannada language not after he became a Judge, but even when he was practicing law in Dharwad during 1977. Everything was being done in Kannada - filing petitions, conducting cross-examinations and enquiring witnesses. His intention was to popularize the usage of Kannada language in the courts. In 1985, when he assumed office as a Munsiff in Chikkanayakanahalli, there were no proper arrangements for issuing judgements in Kannada. During those days, he issued judgements in Kannada by writing them in his own hand. He continued to give judgements in Kannada at places where he worked, in Athani, Soraba, Davanagere, Bantwal and Sagar and even later when he was promoted as a District Magistrate at Bangalore, Koppal, Karwar and Shimoga.

Not an easy task

It is no easy task to implement Kannada especially in a country that has been ruled by the British for hundreds of years. The right Kannada word whose meaning is equivalent to English has to be identified, which also must be appropriate for the occasion. If there is any error in the usage, the whole meaning gets changed. Mittalkod has been quite successful in his attempts to overcome all these limitations. The judges are greatly benefited if the short-hand writers and the typists they get while giving judgements, are well-versed in Kannada. When Mittalkod was appointed as Judge in Karwar, he faced the same difficulty, but in all other places there was not much of a problem as he was able to get staff who could readily adjust to his issuing of judgements in Kannada. His long-cherished dream of issuing civil judgements in Kannada was also fulfilled when he was appointed in Shimoga. So far he has written six appeals in Kannada. With this, he has given judgements involving criminal, motor vehicle cases, murder cases and several other cases, all in Kannada.

Mittalkod is not only a judge, but also a writer. The two poetry collections written by him Akarsha and Utkarsha have been published. He has also written two books on law, one dealing with dishonouring of bank cheques and other, a manual on laws. Before becoming a judge, he had written articles in several papers.

Kannada usage

Except while cross-examining the witnesses, the usage of Kannada in judiciary is very less, which is about 25%. Keeping this in mind, the High Court has issued a circular to popularise the usage of Kannada in courts. There are about 700 judges in the State. Among them the number of judges honestly trying to implement Kannada is about 50. Last year when the State Government honoured Mittalkod for writing judgements in Kannada, several began seriously thinking of doing the same.
